How the award is decided

Response to needs description EPJ, Demonstration and own testing, Total tender sum, Climate and environmental considerations — requirements in the requirement specifications instead of weighting The procurement is for a cloud based electronic patient journal with the accompanying services for 27 municipalities in Nordland, Troms and Finnmark, with approx. 103,000 inhabitants. Climate and environmental considerations are taken care of through the requirements in the requirement specifications (the needs description point 1.8) instead of a weighted award criterion, cf. the Procurement Act § 5b second paragraph third and fourth periods. The contracting authority has mapped where the procurement ́s climate footprint occurs, and has identified two main sources: 1. Travel activities with implementation, training and user support. The 27 municipalities are spread out over three counties with large distances and limited road connections, so that physical attendance largely involves flights. The implementation includes the establishment, migration and training in each individual municipality. 2. Energy consumption in the data centres where the solution is operated 24 hour continuously throughout the agreement period. The contracting authority has assessed the weighting of climate and the environment by a minimum of 30 percent, and has concluded that the requirements in the requirement specifications provide a better climate effect in this procurement: * The requirement for digital delivery as a main rule (point 1.8.1) is a concrete climate measure as a part of the contract. This reduces a significant source of emissions directly for all 27 municipalities, regardless of which tenderer is awarded the contract. A weighted criterion would only give a relative advantage in the award, without committing the chosen tenderer to a specific level. * The market has few real tenderers, and these use in the significantly comparable cloud infrastructure. A weighted environmental criteria would therefore have little effect on which data centres are used, and thus not reduce emissions from operations. The requirement for annual climate and energy reporting (point 1.8.2) instead provides the basis for ongoing follow-up of emissions throughout the entire contract period. * The contract will be valid without a fixed completion date. Contractual requirements with annual reports and sanctions for breaches give a permanent effect, but an award criteria only works at the time of award. Breaches of the requirements are sanctioned in accordance with the contract ́s provisions, cf. the Procurement Act § 5p.
